GetMotors Dealer Terms of Service

1. Who these terms are between

These terms are between [GetMotors legal entity name, company number and registered address — to be confirmed] ("GetMotors", "we") and the business that signs up for a GetMotors account ("the Dealer", "you"). The person who signs up confirms they are authorised to accept these terms on the Dealer's behalf.

2. What GetMotors provides

GetMotors provides software for running a used-car dealership website: a hosted storefront, a stock and leads dashboard, reservation deposits taken through our payment provider, notifications and related tools ("the Service").

GetMotors provides the website platform only. GetMotors is not a party to any sale between the Dealer and its customers, is not a lender and is not a credit broker.

3. Your account

You must give accurate details when you sign up and keep them up to date.

You are responsible for everyone you invite to your account and for keeping sign-in details secure. Turn on two-factor authentication for every account that can change settings or billing.

Tell us straight away if you believe your account has been accessed without permission.

4. Your responsibilities as a dealer

Everything you publish — vehicle descriptions, prices, photos, finance illustrations, pages and banners — must be accurate and lawful. You are the advertiser and the seller.

You are responsible for holding any permissions your activities need, including FCA authorisation for credit broking where you introduce customers to finance.

You are the data controller for the personal data of your customers collected through your storefront. You must have a privacy notice that is accurate for your business and answer your customers' data-protection requests. Our Data Processing Agreement sets out how we handle that data for you.

You are responsible for the terms on which you take reservation deposits and for refunding them in line with those terms and consumer law.

You decide whether to enable analytics and advertising tags on your storefront, and you are responsible for configuring a consent banner for them.

5. Fees

You pay the fees for the plan you choose, in advance, through our billing provider. Plans, prices and any trial are shown at signup and in your billing screen. [Payment terms, late payment and price-change notice periods — to be confirmed.]

6. Acceptable use

You must not use the Service to publish unlawful, misleading or infringing content, to send messages to people who have not agreed to receive them, to attempt to access another dealer's data, or to interfere with the Service.

7. Availability and changes

We aim to keep the Service available and will tell you in advance about planned downtime where we can. We may improve or change features; we will not remove a core feature you rely on without reasonable notice. [Service levels — to be confirmed.]

8. Intellectual property

You keep ownership of the content you upload and give us the rights we need to host and display it as part of the Service. We keep ownership of the GetMotors software and brand.

9. Liability

Nothing in these terms limits liability that cannot be limited by law. [Caps on liability, exclusions and indemnities — to be drafted by a solicitor.]

10. Ending the agreement

You can cancel at the end of any billing period from your billing screen. We may suspend or end your account if you seriously or repeatedly breach these terms. When your account ends we will delete or return your customers' personal data as set out in the Data Processing Agreement.

11. Changes to these terms

We will give you notice before changing these terms. The version you accepted, and when, is recorded against your account.

12. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
